This policy is aligned with the latest legislation changes in the UK, including the introduction of the Worker Protection (Amendment of Equality Act 2010) Bill, which enhances protection for employees from sexual harassment in the workplace.

2. Definition of Sexual Harassment

Sexual harassment is any unwanted behaviour of a sexual nature that violates a person’s dignity, creates an intimidating, hostile, degrading, humiliating, or offensive environment for them. This includes but is not limited to:

  • Unwanted physical contact or advances.
  • Inappropriate comments, jokes, or sexual innuendos.
  • Displaying or sharing sexually explicit material.
  • Pressuring someone for sexual favours.
  • Any form of sexual conduct that impacts the work environment negatively.

3. Employee Rights

Under this policy and UK law, all employees have the right to:

  • Work in a safe and respectful environment.
  • Be free from sexual harassment in the workplace.
  • Report incidents of sexual harassment without fear of retaliation.
  • Have all complaints taken seriously and addressed in a timely and confidential manner.

4. Manager and Leadership Responsibilities

At Wing Woman Plus, all managers, leaders and team members have a responsibility to:

  • Set a standard of respect and professionalism in the workplace.
  • Take immediate and appropriate action if they witness or are informed about any instances of sexual harassment.

5. Reporting Sexual Harassment

Any employee who feels they have been subjected to sexual harassment, or who witnesses harassment happening to someone else, is encouraged to report the incident as soon as possible. Reports can be made:

Wing Woman Plus will ensure all reports are investigated promptly, thoroughly, and confidentially. All employees involved in a complaint will be treated with fairness and respect throughout the investigation.

6. Investigating Complaints

Upon receiving a complaint, Wing Woman Plus will:

  1. Acknowledge receipt of the complaint within 48 hours.
  2. Assign a trained and impartial investigator to handle the case.
  3. Gather all relevant details through interviews and evidence collection, ensuring confidentiality is maintained at all times.
  4. Aim to complete investigations within 14 days, where possible, and provide regular updates to the person who raised the concern.
  5. Take appropriate disciplinary action if the investigation confirms that harassment occurred, which may include warnings, suspension, or termination of employment.

7. Third-Party Harassment

In line with the new bill, Wing Woman Plus recognises its duty to protect employees from harassment by third parties (e.g., clients, customers, contractors). If an employee feels they have been harassed by a third party, they should report the incident using the same reporting procedures as outlined above.

The company will investigate such complaints thoroughly and take necessary action, including preventing the third party from continuing contact with employees if necessary.

8. Retaliation and Victimisation

Retaliation against an individual for reporting sexual harassment or for participating in an investigation is strictly prohibited and will result in disciplinary action. Wing Woman Plus will ensure that no employee is victimised as a result of making a complaint.

9. Preventative Measures and Training

Wing Woman Plus is committed to preventing sexual harassment through:

  • Regular training and awareness programmes for all employees, including management.
  • Clear communication of acceptable behaviour and zero-tolerance towards sexual harassment.
